These terms and conditions of sale are concluded between EURL LES ATELIERS DE MARINETTE, with its registered office in Lyon, registered with the RCS Lyon 820 673 838 00018, hereinafter referred to as Les ateliers de Marinette, on the one hand, and any individual or legal entity wishing to make a purchase via the Internet site or on commercial web platforms, hereinafter referred to as "the buyer", on the other hand.
Purpose
These terms and conditions of sale define the contractual relationship between Les ateliers de Marinette and the buyer, and the conditions applicable to any purchase made through Les ateliers de Marinette's merchant site, whether the buyer is a professional or a consumer.
The acquisition of goods through this site implies unreserved acceptance by the buyer of these terms and conditions of sale.
These terms and conditions of sale shall prevail over any other general or specific conditions not expressly approved by Les Ateliers de Marinette. Les Ateliers de Marinette reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the buyer's order.
Characteristics of the goods and services offered
The products and services offered are those listed in the shop published on Les ateliers de Marinette's website.
These products and services are offered subject to stock availability.
Each product offered for sale on this site is second-hand; condition descriptions are provided on each product page, and photos offer a general—not specific—overview of the condition of the products for sale.
The weight indicated for each item is the weight of the item intended for shipment, including all packaging costs and weight, and does not accurately reflect the weight of the item alone.
The photographs in the shop are as accurate as possible but cannot guarantee a perfect similarity with the product offered, particularly concerning colors.
Prices
Prices in the used goods catalog are prices on which VAT does not apply, according to article 297 A of the CGI concerning the sale of used items. Les ateliers de Marinette reserves the right to modify its prices at any time, it being understood that the price listed in the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated do not include order processing, transport, and delivery costs.
New items and services are subject to 20.00% VAT.
Orders
The buyer, who wishes to purchase a product or service, must:
- complete the identification form where they will provide all requested details or provide their customer number if they have one;
- complete the online order form by providing all references for the chosen products or services;
- validate their order after reviewing it;
- make payment under the stipulated conditions;
- confirm their order and payment.
Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgment of having full knowledge of them, and waiver of the right to invoke one's own purchase conditions or other conditions.
All data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will be equivalent to a signature and acceptance of the operations carried out.
The seller will send an email confirmation of the recorded order.
Les ateliers de Marinette undertakes to fully reimburse the buyer if the item purchased on the site was previously sold in the shop at 46 rue Saint Georges. Shop customers remain a priority over the buyer for the same item purchased at the same time.
Gift Voucher and Gift Card
Gift vouchers and gift cards are valid for 1 year from the date of purchase. They cannot be exchanged for cash or refunded beyond the legal withdrawal period. Customers are responsible for using their gift voucher/card and must anticipate the expiration date.
Withdrawal
Buyers, who are non-professional individuals, benefit from a legal withdrawal period of fourteen (14) days from the delivery of their order to return the product to the seller for exchange or refund without penalty, with the exception of return costs which remain at the buyer's expense.
The withdrawal period also applies to the purchase of gift vouchers which, if they have a validity period of 1 year from the order confirmation date, cannot be refunded beyond the legal period of fourteen (14) days.
Payment Methods
The price is due upon order.
Payments can be made by credit card, Paypal, or bank transfer.
If payment is made by credit card, it will be processed through the secure Systempay or Paypal system so that the information transmitted is encrypted by software and no third party can access it during transport over the network.
In the case of a bank transfer, the order will only be confirmed, prepared, and then shipped upon receipt of the amount due in our bank account. Consequently, the delivery times applicable in this case run from the day of receipt of payment and may therefore vary depending on those announced in the delivery conditions.
Upon the buyer's request, a paper invoice will be sent to them.
Payments by check are accepted; payment must be sent within a maximum of one week, otherwise the item will be put back on sale. Once received, Les Ateliers de Marinette has a period of one week after the check is cashed before sending the item, to avoid bounced checks. The time between purchase and receipt will therefore be longer when paying by check. The check should be made out to: Les ateliers de Marinette.
Deliveries
Deliveries are made to the address indicated on the order form. If this address is outside France, a change in shipping costs may be made, the buyer will be informed of this change and will be able to refuse the purchase.
Risks are borne by the buyer from the moment the products leave Les ateliers de Marinette's premises. In case of damage during transport, a reasoned protest must be made to the carrier within three days of delivery, by registered mail.
Deliveries are made from Tuesday to Saturday morning. The buyer should therefore receive their purchase within two working days in Metropolitan France (excluding Sundays and public holidays) according to the deadlines of the carrier chosen by the seller (La Poste, Colissimo service). International shipments will have an additional delay. Beyond thirty days of waiting within French territory, the buyer can terminate the contract and be reimbursed by Les ateliers de Marinette, unless the latter provides proof of shipment of their purchase. In this case, the buyer will have to turn to the carrier.
For deliveries to a pickup point, the buyer will be responsible for selecting the point and will have taken note of the time allowed to pick up their order once delivery has been made to the pickup point. Les ateliers de Marinette cannot be held responsible if the buyer has not picked up their order within the time allotted by the pickup point. If the package is returned, the buyer may request a reshipment of their order by paying new shipping costs. If the buyer wishes a refund, they will be refunded the value of the products, excluding shipping costs.
In-store pickup
The buyer has the option to order products and pick them up for free at our shop at 46 Rue Saint-Georges 69005 Lyon. The order can be picked up upon receipt of a confirmation message that the order is ready. The buyer has a maximum of three months to pick up their order. After this period, the buyer will not be able to pick up their order, nor benefit from a refund or exchange.
Return after failed delivery
If the delivery could not be made and the order was returned to Les ateliers de Marinette, the buyer will be notified upon receipt of the order at our shop at 46 Rue Saint-Georges 69005 Lyon. They will have three months to seek recourse. After this period, the buyer will not be able to obtain a new shipment or a refund.
